Chapter 1 General Provisions

Article 1: In order to strengthen the management of air cargo transportation and maintain normal air transportation order, this rule is formulated in accordance with the provisions of the Civil Aviation Law of the People's Republic of China.

This rule applies to the transportation of civil air cargo where the place of departure, agreed stopping place, and destination are all within the territory of the People's Republic of China.

Article 2: The carrier shall organize the transportation of goods in a safe, rapid, accurate, and economical manner in accordance with the principles of ensuring key points, considering general needs, and reasonable transportation, reflecting the purpose of People's Aviation for the people.

Article 3: The following terms in these rules, unless otherwise specified in specific provisions, have the following meanings:

(1) "Carrier" refers to all air carriers who accept air waybills or keep cargo records filled out by consignors, and all air carriers who transport or engage in the transportation of goods or provide any other services for such transportation.

(2) "Agent" refers to any person authorized to represent the carrier in the transportation of air cargo.

(3) The shipper refers to the person who enters into a contract with the carrier for the transportation of goods and signs it on the air waybill or cargo record.

(4) "The consignee" refers to the person who delivers the goods by the carrier according to the name listed on the air waybill or cargo transport record.

(5) The "consignment note" refers to the written document filled out by the consignor when handling the consignment of goods, which is the credential for filling out the air waybill.

(6) "Air waybill" refers to the evidence of a contract between the consignor and the carrier for the carriage of goods on the carrier's route, which is filled out by the consignor or the carrier commissioned by the consignor.

Chapter 2 Consignment of goods

Article 4: The consigned goods shall be accompanied by the consignor's resident ID card or other valid identification documents, and the consigned goods shall be filled out in the consignment form, and the consigned procedures shall be handled with the carrier or its agent. If the carrier or its agent requests a letter of introduction or other valid proof from the unit, the shipper should also provide it. Goods that are restricted by government regulations for transportation and goods that require procedures to be processed with relevant government departments such as public security and quarantine shall be accompanied by valid certificates.

The filling and basic content of the consignment note for goods:

1.The shipper shall carefully fill out the contents of the consignment note, be responsible for the authenticity and accuracy of the contents, and sign or stamp on the consignment note.

2.The basic content of the consignment note for goods:

(1)The full names, detailed addresses, telephone numbers, and postal codes of the specific units or individuals of the consignor and consignee of the goods;

(2)Product name of the goods;

(3)Number of goods, packaging method and marking;

(4)Actual value of goods;

(5)Declared value of goods;

(6)General cargo transportation or express delivery;

(7)Characteristics of goods, storage and transportation, and other instructions.

3.For goods with different transportation conditions or unable to be transported together due to the nature of the goods, separate consignment notes should be filled out.

Article 5: The packaging of goods shall ensure that the goods are not damaged, lost, leaked, or contaminated with aircraft equipment or other items during transportation.

The shipper shall use appropriate inner and outer packaging materials and forms according to the nature and weight of the goods, transportation environmental conditions, and carrier's requirements, and properly package them. Precise, fragile, shock resistant, pressure resistant, and non reversible goods must have appropriate packaging measures to prevent damage to the goods. It is strictly prohibited to use straw bags or straw ropes for packaging.
Prohibited or restricted items, dangerous goods, valuable items, confidential documents and information are not allowed to be carried inside the packaging of goods.

Article 6: The consignor shall indicate on the outer packaging of each piece of goods the departure station, destination station, and the unit, name, and detailed address of the consignor and consignee.

The consignor shall affix air transport instruction labels on the outer packaging of the goods according to the nature of the goods and the style specified in national standards.

When the consignor uses old packaging, they must remove the old signs and labels on the original packaging.

The consignor shall affix or attach the carrier's cargo transport label to Each item of goods as required.

Article 7: The weight of goods shall be calculated based on gross weight, and the unit of measurement shall be kilograms. Rounding off the remainder of a weight less than 1 kilogram. When the weight of the cargo on each air waybill is less than 1 kilogram, it shall be calculated as 1 kilogram. Valuable items are calculated based on their actual gross weight, with a unit of measurement of 0.1 kilograms.

The weight of each cargo carried by non wide body aircraft generally does not exceed 80 kilograms, and the volume generally does not exceed 40 x 60 x 100 centimeters. The weight of each cargo carried by a wide body aircraft generally does not exceed 250 kilograms, and the volume generally does not exceed 100 x 100 x 140 centimeters. For goods exceeding the above weight and volume, the carrier may determine the maximum weight and volume of the goods that can be collected and transported based on the aircraft type and the loading and unloading equipment conditions of the departure and destination airports.
The total length, width, and height of each piece of goods shall not be less than 40 centimeters.

Goods with a volume exceeding 6,000 cubic centimeters per kilogram are considered light foam goods. Light foam goods weigh 1 kilogram per 6,000 cubic centimeters.

Article 8: If the gross weight of the goods consigned by the consignor is more than RMB 20 per kilogram, the consignor may declare the value of the goods and pay a declared value surcharge in accordance with regulations.

The declared value of each waybill generally does not exceed RMB 500,000.

When the goods that have been checked in require a change, the declared value surcharge will not be refunded.

Chapter 3 Cargo Transportation

Section 1 Goods Collection and Transportation

Article 9: The carrier shall collect and transport the goods in a planned manner based on the transportation capacity, the nature and urgency of the goods.
For connecting goods with large quantities and specific conditions and time requirements, the carrier must arrange the connecting transshipment space in advance before they can be collected and transported.

In case of special circumstances, such as government regulations, natural disasters, suspension of navigation, or serious backlog of goods, the carrier may suspend the collection of goods.

All items prohibited from transportation by national laws, regulations, and relevant provisions are strictly prohibited from being collected. Any restricted items must meet the prescribed procedures and conditions before they can be collected for transportation.

Goods that need to be inspected, quarantined, and processed by the competent department shall not be accepted for transportation until the procedures are completed.

Chapter 3 Cargo Transportation

Section 1 Goods Collection and Transportation

Article 9: The carrier shall collect and transport the goods in a planned manner based on the transportation capacity, the nature and urgency of the goods.

For connecting goods with large quantities and specific conditions and time requirements, the carrier must arrange the connecting transshipment space in advance before they can be collected and transported.

In case of special circumstances, such as government regulations, natural disasters, suspension of navigation, or serious backlog of goods, the carrier may suspend the collection of goods.

All items prohibited from transportation by national laws, regulations, and relevant provisions are strictly prohibited from being collected. Any restricted items must meet the prescribed procedures and conditions before they can be collected for transportation.

Goods that need to be inspected, quarantined, and processed by the competent department shall not be accepted for transportation until the procedures are completed.

Article 10: When the carrier receives the goods, it shall verify the valid identification documents of the consignor. Any items restricted by the state for transportation must be verified with a valid certificate of transportation permission issued by relevant national departments.

The carrier shall inspect the packaging of the consignor's consigned goods. If the packaging of the goods does not meet the requirements of air transportation, it must be improved by the consignor before the collection can be processed.

The carrier shall not be responsible for inspecting whether the inner packaging of the consignor's consigned goods meets the requirements. The carrier shall conduct safety inspections on the received goods. All goods loaded and transported within 24 hours after receipt shall be subject to unboxing inspection or inspection by security equipment.

Article 11: The air waybill (hereinafter referred to as the waybill) shall be filled out by the consignor and handed over to the carrier along with the goods. If the carrier fills out the waybill based on the consignment note provided by the consignor and it is signed by the consignor, the waybill shall be deemed to be filled out on behalf of the consignor.

The shipper shall be responsible for the accuracy of the instructions or statements regarding the goods filled out on the waybill.

There are eight copies of the freight bill, including three original copies and five copies. Three original copies are: the first copy is to be handed over to the carrier and signed or stamped by the consignor; The second copy shall be delivered to the consignee, signed or stamped by the consignor and the carrier; The third copy shall be handed over to the shipper and signed and stamped by the carrier after receiving the goods. Three copies have equal legal effect. The carrier may add copies as needed. The carrier's copy of the waybill shall be kept for two years from the day after the issuance of the waybill.

The basic content of a waybill includes:

(1) Place and date of filling out the form;

(2) Departure and destination locations;

(3) The name and address of the first carrier;

(4) The name and address of the shipper;

(5) The name and address of the consignee;

(6) The name and nature of the goods;

(7) The packaging method and quantity of goods;

(8) The weight, volume, or size of the goods;

(9) Billing items and payment methods;

(10) Transportation instructions;

(11) Declaration from the shipper.

Section 2 Freight Transportation

Article 12: For goods that require urgent transportation, the consignor shall indicate the date of shipment and flight on the waybill, and the carrier shall transport them out on the specified date and flight. To handle connecting urgent goods, the carrier must obtain the consent of the connecting station before proceeding.

For goods transported within a limited time, the shipper and carrier shall agree on the arrival date and indicate it on the waybill.

The carrier shall deliver the goods to the destination within the agreed time limit.

The carrier shall transport the goods to the destination as soon as possible in the shipping order specified in Article 13 of this chapter.

Article 13: According to the nature of the goods, the carrier shall ship them in the following order:

(1) Emergency rescue, disaster relief, first aid, diplomatic bags, and government designated emergency transportation items;

(2) Specify the date, flight, and urgent shipment of goods;

(3) Time limited, valuable, and miscellaneous small items;

(4) International and domestic transshipment connecting goods;

(5) Generally, goods are shipped in the order of receipt.

Article 14: The carrier shall establish a cabin control system, reasonably allocate air cargo space based on the available air cargo space on a daily basis, and avoid space waste or cargo backlog.

The carrier shall choose transportation routes based on reasonable or economic principles to avoid roundabout transportation of goods.

The carrier shall establish a captain's notice system when transporting special goods.

Article 15: The carrier shall carefully organize the loading and unloading operations of the carried goods, handle them with care, strictly follow the storage and transportation instructions on the packaging of the goods, and prevent damage to the goods.

The carrier shall accurately load and unload goods according to the loading and unloading documents to ensure flight safety.

The carrier shall establish a sound system for supervising loading and unloading. The loading and unloading of goods should be supervised and inspected by dedicated personnel at the work site.

When it is found that the packaging of the goods is damaged and cannot be continued during transportation, the carrier should make transportation records, notify the consignor or consignee, and seek handling opinions.

When the carrier encounters difficulties in loading and unloading special or oversized goods consigned by the consignor, the consignor or consignee may provide necessary loading and unloading equipment and manpower.

Article 16: The carrier shall establish warehouses for ordinary goods, valuable items, fresh goods, dangerous goods, and other goods respectively based on the volume of inbound and outbound cargo transportation and the characteristics of the goods.

The goods warehouse should establish a sound storage system and strictly handle handover procedures; The goods in the warehouse should be properly stacked and cleared regularly; Take measures to prevent fire, theft, rodents, water, and freezing, ensuring the accuracy and completeness of goods entering and exiting the warehouse.

Article 17: After the consignment of goods, the consignor or consignee may inquire about the transportation status of the goods from the carrier or its agent at the place of departure or destination. When inquiring, the consignor shall present the waybill or provide information such as the waybill number, place of departure, destination, name of goods, number of pieces, weight, and date of consignment.

The carrier or its agent shall promptly respond to inquiries made by the consignor or consignee.

Section 3 Arrival and Delivery of Goods

Article 18: After the goods arrive at the destination station, unless otherwise agreed, the carrier or its agent shall promptly issue a notice of arrival to the consignee. Notification includes two forms: telephone and written. The arrival notice for urgent goods should be sent out within two hours after the arrival of the goods, and for ordinary goods, it should be sent out within 24 hours.

From the day after the arrival notice is issued, the goods will be stored for 3 days free of charge. Overdue withdrawal, the carrier or its agent shall charge storage fees in accordance with regulations.

If the goods are detained by the inspection authority or stored in the carrier's warehouse due to violation of regulations, the consignee or consignor shall bear the storage and other related expenses.

The consignor shall be responsible for notifying the consignee to wait for pick-up at the destination airport for animals, fresh perishable items, and other goods transported on specified dates and flights.

Article 19: The consignee shall pick up the goods with the arrival notice and their resident ID card or other valid identification documents; When entrusting others to pick up the goods, the consignee and the resident ID card or other valid identification documents of the consignee specified in the arrival notice and freight bill shall be used for pickup. If the carrier or its agent requests a letter of introduction or other valid proof from the unit, the consignee shall provide it.

The carrier shall count the number of goods listed on the waybill and deliver them to the consignee. When shortages or damages of goods are found, they should be inspected on the spot together with the consignee. If necessary, a record of transportation accidents should be filled out and signed or stamped by both parties.

When the consignee picks up the goods, if there is any objection to the weight or condition of the outer packaging of the goods, they should raise an on-site inspection or re weigh and verify.

If the consignee picks up the goods and signs for them on the waybill without raising any objections, it shall be deemed that the goods have been delivered in good condition.

Article 20: When the consignor consigns goods that do not match the names listed on the waybill or contain government prohibited or restricted items and dangerous goods, the carrier shall handle them in accordance with the following provisions:

(1) Stop shipping at the departure station, notify the shipper to collect the goods, and the shipping fee will not be refunded.

(2) Stop transportation at the transfer station, notify the shipper that the freight will not be refunded, and for goods with mismatched product names, separate charges will be charged based on the actual transportation segment.

(3) At the arrival station, for shipments with mismatched product names, an additional full shipping fee will be charged.

Article 21: If the goods are not picked up within 14 days from the day after the arrival notice is issued, the destination station shall notify the originating station and seek the shipper's opinion on the handling of the goods; If there is no one to pick up the goods after 60 days and no handling opinion from the shipper has been received, the goods will be considered as undeliverable.

For goods that cannot be delivered, proper counting, registration, and storage should be carried out.

All goods prohibited or restricted from transportation by the state, valuable items, and precious cultural and historical materials shall be transferred to the competent national authorities for processing at no cost; All ordinary means of production and living shall be transferred to the relevant material or commercial departments at a fixed price; Any items that are fresh, perishable, or difficult to store may be handled at the discretion of the carrier. If it is disposed of, the cost incurred shall be borne by the shipper.

The payment that has been priced shall be promptly handed over to the carrier's finance department for safekeeping. Within 90 days from the date of processing, if the shipper or consignee claims the goods, the remaining amount after deducting the storage and processing fees of the goods shall be refunded to the claimant; If no one claims the goods after 90 days, the payment should be submitted to the national treasury.

For the handling results of undeliverable goods, the shipper should be notified through the originating station.

Section 4 Changes in Goods Transportation

Article 22: When the consignor requests a change in the goods that have completed the transportation procedures, they shall provide a written request issued by the original consignor, valid personal documents, and the consignor's copy of the waybill.

The requested goods for transportation change should be all the goods filled out on one waybill.

Transportation changes shall comply with the relevant provisions of these rules, otherwise the carrier has the right not to handle them.

Article 23: The carrier shall promptly handle the shipper's request for changes, modify or reissue the waybill according to the change request, and re charge the freight. If it cannot be processed as required, the shipper should be notified promptly.

Cancel the shipment before shipping the goods, and the carrier may charge a return handling fee.

Article 24: If the transportation of goods is affected due to special tasks performed by the carrier or force majeure factors such as weather, and it is necessary to change the transportation, the carrier shall promptly notify the consignor or consignee and agree on a solution.

The carrier shall handle transportation costs in accordance with the following provisions:

(1) Return the goods at the departure station and refund the full shipping cost.

(2) If the destination station is changed at a midway station, the freight for unused segments will be refunded, and the freight from the changed station to the new destination station will be charged separately.

(3) Transport the goods to the original departure station at the intermediate station and refund the full shipping fee.

(4) Using other modes of transportation at the intermediate station to transport the goods to the destination station, the excess cost will be borne by the carrier.

Section 5 Freight Transportation Costs

Article 25: The freight rate for goods refers to the air transportation price between the departure airport and the destination airport, excluding ground transportation fees and other expenses between the airport and the city.

Valuable items, animals, perishable goods, dangerous goods, coffins, ashes, paper forms, as well as express delivery and urgent goods, will be charged 150% of the normal freight rate.

The calculation method for declared value surcharge is: [declared value - (actual weight x 20)] x 0.5%.

Article 26: The carrier may charge ground transportation fees, return handling fees, storage fees, and other miscellaneous freight charges.

Article 27: The consignor shall pay the freight for the goods in the currency and payment method prescribed by the state. Unless otherwise agreed between the carrier and the consignor, the freight shall be paid as paid.

Chapter 4 Transportation of Special Goods

Special cargo transportation, in addition to complying with the regulations for ordinary cargo transportation, should also comply with the following corresponding special requirements:

Article 28: If the shipper requests urgent transportation of goods, with the consent of the carrier, urgent transportation may be carried out and the express freight shall be charged according to regulations.

Article 29: Microbial products such as bacterial strains and carrier culture media that are harmful to human beings, animals and plants shall not be carried without special approval from the Civil Aviation Administration of China.

Vaccines, antibiotics, serum and other biological products that have been artificially manufactured, refined, and subjected to aseptic treatment can be transported as general cargo if the shipper provides a certificate of sterility and non toxicity.

The storage and transportation of microorganisms and harmful biological products should be kept away from food.

Article 30: The transportation of plants and plant products must be accompanied by a valid "plant quarantine certificate" issued by the plant quarantine department at or above the county level (including) where the consignor is located.

Article 31: The ashes shall be packed in closed plastic bags or other sealed containers, with a wooden box and the outermost layer wrapped in cloth.
The conditions for transporting the coffin:

(1) The shipper shall present a death certificate issued by the hospital and a transportation permit issued by relevant departments, and shall contact the carrier in advance to make an agreement;

(2) The corpse is non infectious;

(3) The corpse has undergone anti-corrosion treatment and is within the anti-corrosion period;

(4) The body is packaged in an iron or wooden coffin, with an iron box and a convenient buckle for loading and unloading. The coffin should be filled with absorbent materials such as sawdust or charcoal, and the coffin should have no leaks and be nailed or welded to ensure that odors and liquids do not spill out;

(5) When handling the consignment, the consignor must provide a certificate of burial issued by the funeral department.

Article 32: The transportation of dangerous goods must comply with the management regulations of the Civil Aviation Administration of China on the safe transportation of dangerous goods by air.

Article 33: Animal transportation must comply with relevant national regulations and provide an immunization certificate and quarantine certificate from the local quarantine department at or above the county level; To transport animals that are under national protection, relevant department approval certificates must also be issued; The shipment of animals within the scope of market management must be certified by the market management department.

When consigning animals, the shipper shall contact the carrier in advance and book the cabin space. When handling the consignment procedures, a declaration form for the transportation of live animals must be filled out. Animals that require specialized care and feeding or require large quantities should be escorted by personnel.

Animal packaging should be easy to load and unload, suitable for animal characteristics and air transportation requirements, and able to prevent animal damage, escape, and contact with the outside world. The bottom should have measures to prevent fecal leakage, ensure ventilation, and prevent animal suffocation. The outer packaging of animals should indicate the precautions for care and transportation.

The consignor and consignee shall deliver and retrieve the animals at the airport, and shall be responsible for the storage of the animals before and after transportation. For animals with special requirements for loading, the shipper shall explain the precautions to the carrier or provide on-site guidance.

The carrier shall pack the animals in aircraft cabins suitable for carrying animals. If an animal dies during transportation, the carrier shall not be liable except for the fault of the carrier.

Article 34: When consigning fresh and perishable goods, the consignor shall provide the longest allowed transportation time and transportation precautions, book the cabin, and send them to the airport for the check-in procedures at the agreed time.

The government stipulates that fresh and perishable items that require quarantine must provide a quarantine certificate from the relevant department.

The packaging should be suitable for the characteristics of fresh and perishable items, without polluting or damaging aircraft and other goods. Passenger flights are not allowed to load fresh and perishable items with unpleasant odors.

Fresh and perishable items that require special care should be provided by the shipper with necessary facilities and, if necessary, escorted by the shipper.

The cost incurred by the carrier for taking protective measures during the transportation and storage of fresh and perishable goods shall be borne by the shipper or consignee.

Article 35: Valuable items include rare and precious metals such as gold, platinum, iridium, rhodium, palladium, and their products; Various gemstones, jade artifacts, diamonds, pearls and their products; Precious cultural relics (including books, paintings, antiques, etc.); Cash, securities, and items with a gross weight of over RMB 2,000 per kilogram.

Valuable items should be packed in sturdy and tight boxes, with well shaped iron hoops and seals at the seams.

Article 36 Firearms and police equipment (referred to as firearms) are special controlled items; Ammunition is a hazardous material under special control. When consigning, the following certificates should be provided:

(1) The consignor must provide a transportation permit issued by the public security bureau of the county or city or a permit issued by the competent national department when consigning various types of firearms and ammunition;

(2) The domestic transportation of various types of firearms and ammunition entering and exiting the country must provide a transport certificate issued by border inspection stations; Firearms and ammunition packaging should be the original factory packaging, and non factory original packaging should be ensured to be sturdy, tight, and stamped. Firearms and ammunition should be packaged separately.

Strict handover procedures are required throughout the transportation of firearms and ammunition.

Article 37: According to the nature of the goods, if a dedicated person is required to take care of and supervise the goods during transportation, the consignor shall send someone to escort them. Otherwise, the carrier has the right to refuse to carry them. Escorting goods requires prebooking of shipping space.

The escort shall fulfill the carrier's requirements for the escorted goods and be responsible for the safe transportation of the goods. The escort shall purchase a ticket and complete the boarding procedures.

The carrier shall not be liable for the loss of goods escorted by the shipper, unless it is proven that it was caused by the carrier's fault. If it is proven that the fault was caused by the carrier, compensation shall be made in accordance with the relevant provisions of Article 45 of these rules.

The carrier shall assist the escort in completing the escort task and affix "Escort" labels on the packaging of the escorted goods. Mark the words "Escort" in the storage and transportation precautions column of the waybill, and indicate the date and flight number of the escort.

Chapter 5 Air Mail and Air Express Transportation

Article 38: Both the consignor and carrier of air mail shall cooperate and closely cooperate with each other, and organize transportation safely, quickly, and accurately according to the published flight plan and mail waybill.

Air mail should be packaged in intact air bags according to the type, and labeled with an "air" label.

The carrier shall prioritize the organization of transportation for the received air postal correspondence.

Dangerous goods and items restricted by the state are not allowed to be carried in air mail.

Air mail should undergo security checks.

Air mail charges corresponding shipping fees based on different transportation time limits.

The carrier is only responsible for postal enterprises when transporting mail.

Article 39: Air express delivery enterprises shall use these rules as the basis and use special marks and packaging.

Air express delivery companies should provide safe, fast, accurate, and high-quality services to shippers, and charge corresponding service fees according to regulations. When a breach of contract occurs, the corresponding economic responsibility shall be borne.

Chapter 6 Cargo Charter and Cabin Transportation

Article 40: When applying for a charter flight, the applicant shall contact the carrier with a letter of introduction from the unit or valid personal identification to negotiate the transportation conditions for the charter flight. After both parties agree, a charter flight contract shall be signed. The charterer and the carrier shall fulfill their respective responsibilities and obligations as stipulated in the charter contract.

When the charterer and the carrier execute the charter contract, each cargo charter shall fill out a consignment note and waybill as the transportation voucher for the charter.

The charterer and carrier may determine the escort based on the nature of the goods, and the escort shall handle the flight ticket and boarding procedures in accordance with the charter contract.

Article 41: The tonnage of chartered aircraft shall be fully utilized by the charterer. If the carrier needs to utilize the remaining tonnage of the chartered aircraft, they should negotiate with the charterer.

Article 42: After the signing of the charter flight contract, except for weather or other force majeure reasons, both the shipper and the carrier shall bear the economic responsibilities stipulated in the charter flight contract.

Before the charterer proposes to change the charter flight, the carrier shall bear the relevant costs of adjusting the flight due to the execution of the charter flight task.

Article 43: For charter flights, the carrier shall charge fees according to the agreement between the two parties.

Article 44: The signing of contracts for applying for cabin or container packaging, as well as the responsibilities and obligations that both parties should undertake, shall be handled in accordance with the relevant provisions of charter flights.

Chapter 7 Compensation for Abnormal Transportation of Goods

Article 45 If the loss, shortage, deterioration, pollution, or damage of the goods is caused by the carrier's reasons, compensation shall be made in accordance with the following provisions:;

(1) If the goods have not been declared for value, the carrier shall compensate according to the actual loss value, but the maximum compensation limit is RMB 20 per kilogram of gross weight.

(2) Goods with declared value that have been processed with the carrier shall be compensated according to the declared value; If the carrier proves that the declared value of the consignor is higher than the actual value of the goods under the Civil Aviation Regulations 1601, compensation shall be made based on the actual loss.

Article 46: If the goods are delivered beyond the time limit stipulated in the transportation contract, the carrier shall compensate in accordance with the provisions of the transportation contract.

Article 47: If the consignor or consignee discovers any loss, shortage, deterioration, pollution, damage or delay in the arrival of the goods, the consignee shall report it to the carrier on the spot, and the carrier shall fill in the transportation accident record in accordance with regulations, which shall be signed or stamped by both parties. If there is a claim, the consignee or consignor shall file a claim with the carrier or its agent within the statutory time limit from the day after the issuance of the accident record. When making a claim for compensation to the carrier, the cargo claim form should be filled out, accompanied by the cargo waybill, transportation accident record, and proof of the content and price of the goods or other valid proof.

If the consignee or consignor fails to make a claim for compensation beyond the statutory claim period, it shall be deemed as an automatic waiver of the right to claim.

Article 48: Claims are generally processed at the destination station. The carrier shall respond to any compensation claims made by the shipper or consignee within two months.

When a carrier that does not accept a claim receives a claim, it shall promptly forward the claim to the relevant carrier and notify the claimant.
Chapter 8 Supplementary Provisions

Article 49: These rules shall come into effect on March 1, 1996. The Civil Aviation Administration of China's Domestic Transport Rules for Goods formulated and issued in 1985 were simultaneously abolished.

第一章 总则

Chapter I General Provisions

第一条 为了加强航空货物运输的管理,维护正常的航空运输秩序,根据中华人民共和国民用航空法的规定,制定本规则。

Article 1    This Regulations is formulated in accordance with the Civil Aviation Law of the People’s Republic of China in order to strengthen the management of aviation cargo transportation and maintain the order of proper aviation transportation.

本规则适用于出发地、约定的经停地和目的地均在中华人民共和国境内的民用航空货物运输。

This Regulations is applicable to civil aviation cargo transportation with the place of departure, the agreed transfer stations and the destination all within the territory of PRC.

第二条 承运人应当按照保证重点、照顾一般、合理运输的原则,安全、迅速、准确、经济地组织货物运输,体现人民航空为人民的宗旨。

Article 2  Carrier shall give expression to the idea that the civil aviation serves the people by safely, quickly, accurately and economically organize for cargo transportation based on the principle of key point guaranteed, normal point cared and reasonable transportation.

第三条 本规则中下列用语,除具体条文中另有规定者外,含义如下:

Article 3  Unless otherwise specified in the specific clauses, the following terms under This Regulations shall have the meaning as follows:

(一)承运人是指包括接受托运人填开的航空货运单或者保存货物纪录的航空承运人和运送或者从事承运货物或者提供该运输的任何其他服务的所有航空承运人。

(1) “Carrier” means all air carriers including one who accepts the Air Waybill (AWB) completed and issued by the Shipper and keep the cargo records and the one who is responsible for the transportation and undertakes the carriage of cargo or provides any other services for such transportation.

(二)代理人是指在航空货物运输中,经授权代表承运人的任何人。

(2) “Agent” means anybody authorized to be on behalf of the Carrier during the transportation of aviation cargo.

(三)托运人是指为货物运输与承运人订立合同,并在航空货运单或者货物记录上署名的人。

(3) “Shipper” means the representative who concludes a contract with the Carrier with respect to cargo transportation and signs on the AWB or cargo records.

(四)收货人是指承运人按照航空货运单或者货物运输记录上所列名称而交付货物的人。

(4) “Consignee” means the representative to whom the Carrier will deliver the cargo according to the name listed in the AWB or cargo transportation records.

(五)托运书是指托运人办理货物托运时填写的书面文件,是据以填开航空货运单的凭据。

(5) “Shipper’s Letter of Instruction (SLI)”means the written document completed by the Shipper while handling the procedures for the cargo transportation which is basis for completing and issuing the AWB.

(六)航空货运单是指托运人或者托运人委托承运人填制的,是托运人和承运人之间为在承运人的航线上承运货物所订立合同的证据。

(6) “Air Waybill” means the document indicating that the Shipper and the Carrier have signed a contract for cargo carriage through the air route of the Carrier. The AWB is completed and developed by the Shipper or the Carrier as authorized by the Shipper.

第二章 货物托运

Chapter II Consignment of Cargo

第四条 托运货物凭本人居民身份证或者其它有效身份证件,填写货物托运书,向承运人或其代理人办理托运手续。如承运人或其代理人要求出具单位介绍信或其它有效证明时,托运人也应予提供。托运政府规定限制运输的货物以及需向公安、检疫等有关政府部门办理手续的货物,应当随附有效证明

Article 4     The Shipper shall present his/her own ID card or other valid identity documents in order to complete the SLI and handle the consignment formalities with the Carrier or his/her Agent. In the event that the Carrier or his/her Agent requires the Letter of Introduction issued by the Shipper’s employer or other valid identity documents, the Shipper shall provide such letter or documents. As to cargo that is restricted from consignment or requires special approval from public security, quarantine or other governmental agencies must be accompanied by valid proof that such agencies have approved the cargo for transport.

货物托运书的填写及基本内容

Completion and basic content of the SLI:

(一)托运人应当认真填写,对托运书内容的真实性、准确性负责,并在托运书上签字或者盖章。

(1) The Shipper shall seriously complete the SLI and be responsible for the authenticity and accuracy of the content with the SLI signed or stamped.

(二)货物托运书的基本内容:

(2) Basic content of the SLI:

1.货物托运人和收货人的具体单位或者个人的全称及详细地址、电话、邮政编码;The specific employers or individual full names and detailed addresses, telephone numbers and postal codes of the Shipper and the Consignee;

2.货物品名;Description of cargo;

3.货物件数、包装方式及标志;Quantity, packing and mark of cargo;

4.货物实际价值;Real value of cargo;

5.货物声明价值;Declared value of cargo;

6普货运输或者急件运输;Regular cargo transportation or time-sensitive transportation;

7.货物特性、储运及其它说明。Cargo characteristics, storage and transportation as well as other instructions.

(三)运输条件不同或者因货物性质不能在一起运输的货物,应当分别填写托运书。

(3) The Shipper shall complete different SLIs respectively for cargo requiring different conditions of carriage or cargo that is incompatible with other cargo to be shipped on a flight.

第五条 货物包装应当保证货物在运输过程中不致损坏、散失、渗漏,不致损坏和污染飞机设备或者其它物品。

Article 5     The cargo shall be packed in such a way so as to prevent damage, dispersion or leakage of the cargo, or damage or pollution to the aircraft or damage to or contamination of other cargo items during the course of carriage.

托运人应当根据货物性质及重量、运输环境条件和承运人的要求,采用适当的内、外包装材料和包装形式,妥善包装。精密、易碎、怕震、怕压、不可倒置的货物,必须有相适应的防止货物损坏的包装措施。严禁使用草袋包装或草绳捆扎。

The Shipper shall adopt appropriate external and internal packing materials and packing forms according to the properties and weight of the cargo, transport conditions and the requirements of the Carrier. For precision cargo, fragile cargo, cargo sensitive to shock and pressure, or cargo that must be transported upright, appropriate packing measures must be taken to prevent any damage to the cargo. Using straw bags or straw ropes to pack or secure the good is strictly prohibited.

货物包装内不准夹带禁止运输或者限制运输的物品、危险品、贵重物品、保密文件和资料等。7501民用航空规章。

Cargo packaging shall not contain any prohibited or restricted goods, hazardous substances, valuables, confidential documents and data. 7501 Civil Aviation Regulations.

第六条 托运人应当在每件货物外包装上标明出发站、到达站和托运人、收货人的单位、姓名及详细地址等。

Article 6    The shipper shall clearly mark each package with the airports of origin and destination, and the companies, names and full addresses of the Shipper and the Consignee.

托运人应当根据货物性质,按国家标准规定的式样,在货物外包装上张贴航空运输指示标贴。

The Shipper shall stick air carriage identification labels to the external packaging of each piece of consigned cargo according to its properties and the form specified in applicable national standards.

托运人使用旧包装时,必须除掉原包装上的残旧标志和标贴。

If a used package is reused, all old tags and labels on the external package must be removed.

托运人托运每件货物,应当按规定粘贴或者拴挂承运人的货物运输标签。Each piece of cargo consigned by the Shipper must be accompanied by a cargo carriage label for the carrier.

第七条 货物重量按毛重计算,计量单位为公斤。重量不足1公斤的尾数四舍五入。每张航空货运单的货物重量不足1公斤时,按1公斤计算。贵重物品按实际毛重计算,计算单位为01公斤。

Article 7   The weight of the cargo is measured by gross weight in kilograms,  and any fractions less than 1 kg are rounded off. If the gross weight of the cargo specified in an Air Waybill is less than 1 kilogram, it will be counted as 1 kilogram. The weight of valuables is measured by gross weight in 0.1 kilograms.

非宽体飞机载运的货物,每件货物重量一般不超过80公斤,体积一般不超过40×60×100厘米。宽体飞机载运的货物,每件货物重量一般不超过250公斤,体积一般不超过100×100×140厘米。超过以上重量和体积的货物,承运人可依据机型及出发地和目的地机场的装卸设备条件,确定可收运货物的最大重量和体积。

For cargo carried in non-wide-body aircraft, the weight of each piece of cargo shall not exceed 80 kilograms and its dimension shall not exceed 40×60×100 centimeters. For cargo carried in wide-body aircraft, the weight of each piece of cargo shall not exceed 250 kilograms and its dimension shall not exceed 100×100×140 centimeters. For any cargo that exceeds these weight or dimension limits, the Carrier may determine the max. acceptable weight and dimension of cargo according to the conditions of the handling equipment at the airports of origin and destination.

每件货物的长、宽、高之和不得小于40厘米。

The sum of the length, width and height of each piece of cargo shall be no less than 40 centimeters.

每公斤货物体积超过6000立方厘米的,为轻泡货物。轻泡货物以每6000立方厘米折合1公斤计重。

Light bulky cargo means the cargo with a weight of 1 kilogram but a volume of more than 6000 cubic centimeters. Every 6,000 cubic centimeters of light bulky cargo is counted as 1 kilogram.

第八条 托运人托运的货物,毛重每公斤价值在人民币20元以上的,可办理货物声明价值,按规定交纳声明价值附加费。

Article 8  For the Shipper’s cargo with value exceeding RMB 20.00 per kilogram, the Shipper may declare the value of the cargo and pay a value declaration surcharge as required.

每张货运单的声明价值一般不超过人民币50万元。

The declared value of each Air Waybill shall not exceed RMB 500,000.

已办理托运手续的货物要求变更时,声明价值附加费不退。

If a Shipper requests any change to the consigned cargo, the value declaration surcharge is not refundable.

第三章 货物承运

Chapter III Carriage of Cargo

第一节 货物收运

Section 1 Acceptance and Carriage of Cargo

第九条 承运人应当根据运输能力,按货物的性质和急缓程度,有计划地收运货物。

Article 9  The Carrier shall systematically accept and carry the cargo according to the transportation capability and the properties and time-sensitive degree of the cargo.

批量大和有特定条件及时间要求的联程货物,承运人必须事先安排好联程中转舱位后方可收运。

As to connecting flight cargo subject to big batch and specific conditions and time requirements, the Carrier must accept and carry the cargo only with the transfer freight space of the connecting flight prepared in advance.

遇有特殊情况,如政府法令、自然灾害、停航或者货物严重积压时,承运人可暂停收运货物。

The Carrier may suspend the acceptance and carriage of cargo in case of special circumstances, such as government decree, natural disaster, suspension of air or shipping service and overstock of cargo.

凡是国家法律、法规和有关规定禁止运输的物品,严禁收运。凡是限制运输的物品,应符合规定的手续和条件后,方可收运。

It is prohibited to accept and carry any cargo which is forbidden to be transported according to national laws, regulations and relevant rules. Any cargo which is restricted from transport shall be accepted and carried only with the specified formalities and conditions achieved.

需经主管部门查验、检疫和办理手续的货物,在手续未办妥之前不得收运。

Any cargo required of inspection, quarantine and formalities handling by the competent department is prohibited to be accepted and carried until the formalities have been completed.

第十条 承运人收运货物时,应当查验托运人的有效身份证件。凡国家限制运输的物品,必须查验国家有关部门出具的准许运输的有效凭证。

Article 10 The Carrier shall verify the valid identity document of the Shipper for acceptance and carriage of cargo. As to any cargo restricted from carriage by the nation, it is required to verify the valid certificate for transport approval issued by related national department.

承运人应当检查托运人托运货物的包装,不符合航空运输要求的货物包装,须经托运人改善包装后方可办理收运。

The Carrier shall check the packing of the cargo consigned by the Shipper. Any cargo packing failed to meet the requirements of air transport must be corrected by the Shipper before handling the acceptance and carriage of cargo.

承运人对托运人托运货物的内包装是否符合要求,不承担检查责任。承运人对收运的货物应当进行安全检查。对收运后24小时内装机运输的货物,一律实行开箱检查或者通过安检仪器检测。

The Carrier is not responsible for checking whether the internal packing of the cargo consigned by the Shipper is in accordance with the requirements. The consigned cargo shall be subject to the security check conducted by the Carrier. The cargo to be shipped within 24 hours upon the acceptance shall be subject to a physical check or checked by a security check device.

第十一条 航空货运单(下称货运单)应当由托运人填写,连同货物交给承运人。如承运人依据托运人提供的托运书填写货运单并经托运人签字,则该货运单应当视为代托运人填写。

Article 11 The Air Waybill (hereinafter referred to as AWB) shall be completed by the Shipper and submitted together with the cargo to the Carrier. In the event the Carrier completes the AWB based on the Shipper’s Letter of Instruction provided by the Shipper and such AWB is signed by the Shipper, it shall be deemed that this AWB is completed by the Carrier on behalf of the Shipper.

托运人应当对货运单上所填关于货物的说明或声明的正确性负责。

The Shipper shall be responsible for the accuracy of the description or statement with respect to cargo in the AWB.

货运单一式八份,其中正本三份、副本五份。正本三份为:第一份交承运人,由托运人签字或盖章;第二份交收货人,由托运人和承运人签字或盖章;第三份交托运人,由承运人接受货物后签字盖章。三份具有同等效力。承运人可根据需要增加副本。货运单的承运人联应当自填开货运单次日起保存两年。

The Air Waybill is made in eight counterparts of original, three of which are originals and five of which are counterparts. As to three originals: the first is provided to the Carrier with the signature or seal of the Shipper; the second is provided to the Consignee with the signatures or seals of the Shipper and the Carrier; the third is provided to the Shipper with the signature and seal of the Carrier after accepting the cargo. All of three originals have equal legal force. The Carrier may increase the quantity of the counterparts as required. The Carrier’s part of the AWB shall be kept for 2 years from the next day upon completing the AWB.

货运单的基本内容包括:

The basic content of the AWB includes:

(一)填单地点和日期;

(1) Place and date of completing the AWB;

(二)出发地点和目的地点;

(2) Place of origin and destination;

(三)第一承运人的名称、地址;

(3) Name and address of the first Carrier;

(四)托运人的名称、地址;

(4) Name and address of the Shipper;

(五)收货人的名称、地址;

(5) Name and address of the Consignee;

(六)货物品名、性质;

(6) Description and property of the cargo;

(七)货物的包装方式、件数;

(7) Packing form and quantity of the cargo

(八)货物的重量、体积或尺寸;

(8) Weight, volume or dimension of the cargo;

(九)计费项目及付款方式;

(9) Charging item and payment method;

(十)运输说明事项;

(10) Matters related to transportation description;

(十一)托运人的声明。

(11) Statement of the Shipper.

第二节 货物运送

Section II      Transportation of Cargo

第十二条 需办理急件运输的货物,托运人应当在货运单上注明发运日期和航班,承运人应当按指定的日期和航班运出。需办理联程急件货物,承运人必须征得联程站同意后方可办理。

Article 12 As to cargo required of time-sensitive transport, the Shipper shall indicate the shipping date and flight on the AWB and the Carrier shall transport the cargo according to the specified date and flight. As to cargo required of connecting flight time-sensitive transport, the Carrier can accept only upon obtaining the approval of the connecting flight station in advance.

限定时间运输的货物,由托运人与承运人约定运抵日期并在货运单上注明。

As to the cargo with limiting transport time, the Shipper and the Carrier shall achieve an agreement on the date of arrival which is to be indicated on the AWB.

承运人应当在约定的期限内将货物运抵目的地。

The Carrier shall deliver the cargo to the destination within the agreed time limit.

承运人应当按本章第十三条的发运顺序尽快将货物运抵目的地。8501中国民用航空法律法规汇编 

The Carrier shall deliver the cargo to the destination as soon as possible according to the shipping order under Article 13 of this chapter. 8501 Collection of the Civil Aviation Laws and Regulations of China

第十三条 根据货物性质,承运人应按下列顺序发运:

Article 13 According to the properties of cargo, the Carrier shall conduct shipping in accordance with the following order:

(一)抢险、救灾、急救、外交信袋和政府指定急运的物品;

(1) Cargo for emergency rescue, disaster relief, emergency treatment and diplomatic pouch and cargo subject to time-sensitive transport designated by the government;

(二)指定日期、航班和按急件收运的货物;

(2) Cargo subject to specified date, flight and time-sensitive transport;

(三)有时限、贵重和零星小件物品;

(3) Cargo with time limits, valuables and small bits and pieces;

(四)国际和国内中转联程货物;

(4) Connecting flight cargo subject to international and domestic transfer shipment;

(五)一般货物按照收运的先后顺序发运。

(5) As to general cargo, the sequence of acceptance and transport shall prevail.

第十四条 承运人应当建立舱位控制制度,根据每天可利用的空运舱位合理配载,避免舱位浪费或者货物积压。

Article 14 The Carrier shall build the control system of freight space to achieve reasonable loading based on the daily available freight space of air transport in order to avoid waste of freight space or overstock of cargo.

承运人应当按照合理或经济的原则选择运输路线,避免货物的迂回运输。

The Carrier shall select the transport route on a reasonable or economical basis to avoid round about transport.

承运人运送特种货物,应当建立机长通知单制度。

The Carrier shall build the Notification to Captain System for transport of special cargo.

第十五条 承运人对承运的货物应当精心组织装卸作业,轻拿轻放,严格按照货物包装上的储运指示标志作业,防止货物损坏。

Article 15 The Carrier shall well organize for loading and unloading operation with respect to the carried cargo. Handle the cargo gently and strictly follow the indications and marks of storage and transportation on the cargo package to avoid damages.

承运人应当按装机单、卸机单准确装卸货物,保证飞行安全。The Carrier shall load and unload the cargo according to the loading list and unloading list in order to ensure air safety.

承运人应当建立健全监装、监卸制度。货物装卸应当有专职人员对作业现场实施监督检查。

The Carrier shall build the sound supervision system for loading and unloading. Specially-assigned person shall be required to supervise and check the working site for cargo loading and unloading.

在运输过程中发现货物包装破损无法续运时,承运人应当做好运输记录,通知托运人或收货人,征求处理意见。

In the event that any damage to the cargo package is found during the course of transport, the Carrier shall well prepare the transport records and ask the Shipper or the Consignee for treatment suggestions.

托运人托运的特种货物、超限货物,承运人装卸有困难时,可商托运人或收货人提供必要的装卸设备和人力。

In the event that the Carrier is difficult to load and unload the special cargo and out-of-gauge cargo consigned by the Shipper, it is available to request the Shipper or the Consignee to provide essential loading and unloading equipment and manpower through consultation.

第十六条 承运人应当根据进出港货物运输量及货物特性,分别建立普通货物及贵重物品、鲜活物品、危险物品等货物仓库。

Article 16 The Carrier shall build the warehouses for regular cargo and valuables, fresh cargo, dangerous cargo and others respectively in accordance with the inward and outward transportation volume and the properties of cargo.

货物仓库应当建立健全保管制度,严格交接手续;库内货物应当合理码放、定期清仓;做好防火、防盗、防鼠、防水、防冻等工作,保证进出库货物准确完整。

The warehouse shall be provided with sound storage system and strict handing-over procedures. The cargo in the warehouse shall be arranged reasonably and subject to regular inventory. The measures for fireproofing, prevention of burglary, ratproof, waterproof, freeze proof and others shall be well prepared. Ensure the accuracy and integrity of the cargo stored and sent.

第十七条 货物托运后,托运人或收货人可在出发地或目的地向承运人或其代理人查询货物的运输情况,查询时应当出示货运单或提供货运单号码、出发地、目的地、货物名称、件数、重量、托运日期等内容。

Article 17 The shipper and the consignee may check the transport status of the consigned cargo with the Carrier or its duly authorized Agent at the place of origin or the place of destination. The Air Waybill or Air Waybill number, place of origin, destination of destination, name of cargo, quantity, weight, consignment date and other required information must be provided at the time of inquiry.

承运人或其代理人对托运人或收货人的查询应当及时给予答复。

The Carrier or its duly authorized Agent shall timely respond regarding the inquiry of the Shipper or the Consignee.

第三节 货物到达和交付

Section III Arrival and Delivery of Cargo

第十八条 货物运至到达站后,除另有约定外,承运人或其代理人应当及时向收货人发出到货通知。通知包括电话和书面两种形式。急件货物的到货通知应当在货物到达后两小时内发出,普通货物应当在24小时内发出。

Article 18 Unless otherwise agreed, the Carrier or its duly authorized Agent shall timely serve the Consignee with Arrival Notice upon the cargo has been delivered to the destination. The notification can be made by call or in written. Such notice for the time-sensitive cargo shall be sent within 2 hours upon the arrival of cargo, and the notice for the regular cargo shall be sent within 24 hours upon the arrival of cargo.

自发出到货通知的次日起,货物免费保管3日。逾期提取,承运人或其代理人按规定核收保管费。

Since the next day upon sending the Arrival Notice, the cargo can be stored for 3 days, without charge. The cargo can remain in the Carrier’s custody free of charge for up to three days after the issue date of the Arrival Notice. The Consignee or its Agent shall pay overdue storage fees if he or she fails to pick up the cargo after three days.

货物被检查机关扣留或因违章等待处理存放在承运人仓库内,由收货人或托运人承担保管费和其它有关费用。

If the cargo is detained by the inspection office or remained in the Carrier’s warehouse for waiting for treatment because of violation of regulations, the Consignee or the Shipper shall pay the storage charges and other related expenses.

动物、鲜活易腐物品及其它指定日期和航班运输的货物,托运人应当负责通知收货人在到达站机场等候提取。

For animals, fresh and perishable cargo and other cargo with specified delivery dates and flights, the Shipper shall be responsible for notifying the Consignee when to arrive at the destination airport to pick up the cargo.

第十九条 收货人凭到货通知单和本人居民身份证或其它有效身份证件提货;委托他人提货时,凭到货通知单和货运单指定的收货人及提货人的居民身份证或其它有效身份证件提货。如承运人或其代理人要求出具单位介绍信或其它有效证明时,收货人应予提供。

Article 19 The Consignee shall present an Arrival Notice and ID card or other valid identity document in order to pick up the cargo. If the Consignee assigns another person to pick up the cargo, the assignee must present the Arrival Notice, and the ID card or other valid identity document of the assignee and the Consignee specified in the Air Waybill. The Consignee shall provide a Letter of Introduction issued by his or her employer or other valid proof document if required by the Carrier or its Agent.

承运人应当按货运单列明的货物件数清点后交付收货人。发现货物短缺、损坏时,应当会同收货人当场查验,必要时填写货物运输事故记录,并由双方签字或盖章。

The Carrier shall hand over the cargo to the Consignee after checking the quantity of cargo by referencing the AWB. If any shortage or damage of cargo is found at the time of collection, the Carrier shall propose an on-site verification with the Consignee. If necessary, the cargo transport accident records shall be prepared and signed or stamped by both parties.

收货人提货时,对货物外包装状态或重量如有异议,应当场提出查验或者重新过秤核对。

If the Consignee has any concerns about the external packaging or weight of the cargo at the time of collection, he or she shall propose a verification or re-measurement of the weight prior to leaving the cargo terminal.

收货人提取货物后并在货运单上签收而未提出异议,则视为货物已经完好交付。 In the event that the Consignee signs the AWB after collection and without raising an objection, it shall be deemed that the cargo has been successfully delivered.

第二十条 托运人托运的货物与货运单上所列品名不符或在货物中夹带政府禁止运输或限制运输的物品和危险物品时,承运人应当按下列规定处理:

Article 20 Where the cargo consigned by the Shipper is not consistent with the Air Waybill, includes dangerous goods, or goods prohibited or restricted from carriage by the government, the Carrier may take the following actions:

(一)在出发站停止发运,通知托运人提取,运费不退。

(1) Reject the cargo at the airport of origin, withhold the freight charges and notify the shipper for picking up the cargo.

(二)在中转站停止运送,通知托运人,运费不退,并对品名不符的货件,按照实际运送航段另核收运费。

(2) Suspend transport of the cargo at the airport of transfer, withhold the freight charges, notify the Shipper and charge additional freight charges for cargo with unconformable description.

(三)在到达站,对品名不符的货件,另核收全程运费。

(3) Charge freight charges for cargo with unconformable description for the entire trip at the airport of destination.

第二十一条 货物自发出到货通知的次日起14日无人提取,到达站应当通知始发站,征求托运人对货物的处理意见;满60日无人提取又未收到托运人的处理意见时,按无法交付货物处理。

Article 21 In case that nobody picks the cargo up within 14 days since the next day upon sending the Arrival Notice, the airport of destination shall notify the airport of origin for requesting the suggestions of the Shipper with respect to the treatment of cargo. If nobody picks the cargo up within 60 days upon the above date and no treatment suggestion of the Shipper is received, the cargo shall be treated as undeliverable cargo

对无法交付货物,应当做好清点、登记和保管工作。

For the undeliverable cargo, the corresponding stocktaking, registration and storage shall be well conducted.

凡属国家禁止和限制运输物品、贵重物品及珍贵文史资料等货物应当无价移交国家主管部门处理;凡属一般的生产、生活资料应当作价移交有关物资部门或商业部门;凡属鲜活、易腐或保管有困难的物品可由承运人酌情处理。如作毁弃处理,所产生的费用由托运人承担。

The cargo prohibited and restricted from transport by the nation, valuables, precious historical accounts of past events and other cargo shall be handed over to the competent national department, free of charge. The general means of production and livelihood shall be handed over to related department of material or commercial department. The fresh and perishable cargo or the cargo difficult to store may be treated at the Carrier's own discretion. If disposal is required, the Shipper shall be responsible for the cost generated.

经作价处理的货款,应当及时交承运人财务部门保管。从处理之日起90日内,如有托运人或收货人认领,扣除该货的保管费和处理费后的余款退给认领人;如90日后仍无人认领,应当将货款上交国库。

Within 90 days upon the treatment date, if any Shipper or Consignee claims the cargo, the spare money with the storage fee and handling charges deducted shall be returned to the claimant. If nobody claims after 90 days, the payment for cargo shall be handed in to the national treasury.

对于无法交付货物的处理结果,应当通过始发站通知托运人。9501民用航空规章 The Shipper shall be notified by the airport of origin of the treatment result of undeliverable cargo. 9501 Civil Aviation Regulations.

第四节 货物运输变更

Section 4   Change to Cargo Transportation

第二十二条 托运人对已办妥运输手续的货物要求变更时,应当提供原托运人出具的书面要求、个人有效证件和货运单托运人联。

Article 22 The Shipper shall provide the written requirements issued by the original Shipper, valid personal identity document and the Shipper's part of the AWB if he/she requests any change to the consigned cargo.

要求变更运输的货物,应是一张货运单填写的全部货物。

In the event that the Shipper requests any changes to the consigned cargo, the Shipper must provide a written request issued by the original Shipper, a valid ID certificate and the shipper's original Air Waybill.

运输变更应当符合本规则的有关规定,否则承运人有权不予办理。

The cargo for which a request for change is made shall include all items listed in the Air Waybill.

第二十三条 承运人应当及时处理托运人的变更要求,根据变更要求,更改或重开货运单,重新核收运费。如果不能按照要求办理时,应当迅速通知托运人。

Article 23 The Carrier shall timely handle with the change request proposed by the Shipper and modify or re-issue the AWB and re-charge the freight fee according to the requirements of change. If it fails to fulfill the request, the Shipper shall be quickly notified.

在运送货物前取消托运,承运人可以收取退运手续费。

The Carrier may charge the handling charge for returning the consigned cargo before transport.

第二十四条 由于承运人执行特殊任务或天气等不可抗力的原因,货物运输受到影响,需要变更运输时,承运人应当及时通知托运人或收货人,商定处理办法。

Article 24 If the transport change is required because the cargo transport is affected by the Carrier's execution of special mission or weather and other force majeure events, the Carrier shall timely notify the Shipper or the Consignee in order to achieve a solution.

承运人应当按照下列规定处理运输费用:

The Carrier shall manage the freight charges in accordance with the following rules:

(一)在出发站退运货物,退还全部运费。

(1) All freight charges shall be refunded if the consigned cargo is returned at the airport of origin.

(二)在中途站变更到达站,退还未使用航段的运费,另核收由变更站至新到达站的运费。

(2) The freight charges for the flight segments undelivered shall be refunded if the airport of destination is changed when the consigned cargo arrives at the airport of transfer, and charge additionally the freight charges for delivery from the airport where such change is executed to the airport of new destination.

(三)在中途站将货物运至原出发站,退还全部运费。

(3) All freight charges shall be refunded if the consigned cargo is returned from the airport of transfer to the airport of original origin.

(四)在中途站改用其他交通工具将货物运至目的站,超额费用由承运人承担。

(4) The Carrier shall be responsible for the expenses overrun cause by that the consigned cargo is transported from the airport of transfer to the airport of destination by other means of transportation.

第五节 货物运输费用

Section V    Freight Charges of Cargo

第二十五条 货物运价是出发地机场至目的地机场之间的航空运输价格,不包括机场与市区间的地面运输费及其它费用。

Article 25 The freight charges of the consigned cargo is the price for air transport between the airport of origin and the airport of destination, excluding the expenses for ground transportation between the airport and the urban area and other charges.

贵重物品、动物、鲜活易腐物品、危险物品、灵柩、骨灰、纸型以及特快专递、急件货物等按普通货物运价的150%计收运费。

For transport of valuables, animal, fresh and perishable goods, dangerous goods, coffin, human remains, paper-mache and EMS, time-sensitive cargo and other items, it charges 150% of the freight charges for regular cargo.

声明价值附加费的计算方法为:〔声明价值-(实际重量×20)〕×05%。

The formula for calculating the surcharges of declared value is: [declared value - (actual weight x 20) ] x 0.5%.

第二十六条 承运人可以收取地面运输费、退运手续费和保管费等货运杂费。

Article 26 The Carrier may charge the fee for ground transportation, handling charges for returning the consigned cargo, storage fee and other incidental expenses of freight.

第二十七条 托运人应按国家规定的货币和付款方式交付货物运费,除承运人与托运人另有协议者外,运费一律现付。

Article 27 The Shipper shall pay the freight charges in accordance with the currency and payment method as specified by the nation. Unless otherwise agreed by the Carrier and the Shipper, the freight charges shall be uniformly subject to spot payment.

第四章 特种货物运输

Chapter IV Transportation of Special Cargo

特种货物运输,除应当符合普通货物运输的规定外,应当同时遵守下列相应的特殊要求:

Carriage of special cargo shall be in compliance with the regulations for carriage of regular cargo as well as the following special requirements.

第二十八条 托运人要求急运的货物,经承运人同意,可以办理急件运输,并按规定收取急件运费。

Article 28 If the Shipper requires immediate delivery of cargo, such cargo may be carried as time-sensitive goods upon the consent of the Carrier and specified freight charges shall be paid.

第二十九条 凡对人体、动植物有害的菌种、带菌培养基等微生物制品,非经民航总局特殊批准不得承运。

Article 29 Without special permission from CAAC, the Carrier does not accept the carriage of microbiological products harmful to humans, animals and plants, such as bacterial strains and media containing bacteria.

凡经人工制造、提炼,进行无菌处理的疫苗、菌苗、抗菌素、血清等生物制品,如托运人提供无菌、无毒证明可按普货承运。

The biological products obtained from artificial manufacturing, purification and sterilization treatment, such as vaccines, bacterins, bacteriophages and serums, may be carried as regular cargo if the Shipper provides proof that such items are sterile and non-toxic.

微生物及有害生物制品的仓储、运输应当远离食品。

The microorganism and harmful biological product shall be stored and transported away from the food.

第三十条 植物和植物产品运输须凭托运人所在地县级(含)以上的植物检疫部门出具的有效植物检疫证书

 Article 30 The Shipper shall provide a valid "Plant Quarantine Certificate" issued by a local plant quarantine authority at the county level or above when consigning plants and products of plant origin.

第三十一条 骨灰应当装在封闭的塑料袋或其它密封容器内,外加木盒,最外层用布包装。

Article 31 The human remains shall be placed in a sealed plastic bag or other sealed container and contained in a wooden box inside a cloth bag.

灵柩托运的条件:

Consignment conditions for coffin:

(一)托运人应当凭医院出具的死亡证明及有关部门出具的准运证明,并事先与承运人联系约定;

(1) The Shipper shall present the death certificate issued by the hospital and certificate of transport approval issued by related department and contact with the Carrier to achieve an agreement in advance;

(二)尸体无传染性;

(2) The human remains must be non-contagious;

(三)尸体经过防腐处理,并在防腐期限以内;

(3) The human remains have been embalmed and within the corresponding period;

(四)尸体以铁质棺材或木质棺材为内包装,外加铁皮箱和便于装卸的环扣。棺内敷设木屑或木炭等吸附材料,棺材应当无漏缝并经过钉牢或焊封,确保气味及液体不致外溢;

(4) The human remains shall be placed in an iron coffin or wooden coffin as the internal packing which is equipped externally with handles for loading/unloading. The inside of the coffin shall be paved with absorbing materials as bits of wood or charcoal. The coffin shall be free from leak and well nailed or welded to prevent from leakage of gas and liquid;

(五)在办理托运时,托运人须提供殡葬部门出具的入殓证明。

(5) The Shipper must provide the encoffinning certificate issued by a relevant funeral service authority while applying for consignment.

第三十二条 危险货物的运输必须遵守中国民用航空总局有关危险货物航空安全运输的管理规定。

Article 32 Carriage of dangerous goods shall be in compliance with the Civil Aviation of China Transport of Dangerous Goods by Air of CAAC.

第三十三条 动物运输必须符合国家有关规定,并出具当地县级(含)以上检疫部门的免疫注射证明和检疫证明书;托运属于国家保护的动物,还需出具有关部门准运证明;托运属于市场管理范围的动物要有市场管理部门的证明。

Article 33 Live animals may be shipped in compliance with applicable national regulations. The Shipper shall provide an immunization certificate and Animal Quarantine Certificate issued by a local animal quarantine authority of the county level or above. For animals under national protection programs, a transport permit issued by relevant governmental agency must be provided; for animals within the scope of market management, a certificate issued by the competent market management agency must be available.

托运人托运动物,应当事先与承运人联系并定妥舱位。办理托运手续时,须填写活体动物运输托运申明书。需专门护理和喂养或者批量大的动物,应当派人押运。

The Shipper shall in advance contact with the Carrier in order to arrange the shipping space. The Shipper shall complete the Consignment Certificate for Carriage of Live Animals while handling the formalities of consignment. The shipper shall provide the cargo attendant for animals that require special care and feeding or are carried in large number.

动物的包装,既要便于装卸又需适合动物特性和空运的要求,能防止动物破坏、逃逸和接触外界,底部有防止粪便外溢的措施,保证通风,防止动物窒息。动物的外包装上应当标明照料和运输的注意事项。

Containers for animals shall be suitable for loading/unloading, animal characteristics and air carriage, designed to prevent attacks and/or escape of the animal, providing access to the outside environment, and ensuring good ventilation to prevent suffocation. The container shall be designed to prevent leakage of animal waste. The external package shall be marked with the instructions for animal care and carriage.

托运人和收货人应当在机场交运和提取动物,并负责动物在运输前和到达后的保管。有特殊要求的动物装舱,托运人应当向承运人说明注意事项或在现场进行指导。

The Shipper and Consignee shall conduct the consignment and collection for the animals at the airport, and shall be responsible for animal care and storage before the shipment and after the arrival of such animal. In the case of carriage of animals with special requirements, the Shipper shall provide instructions or on-site guidance to the Carrier.

承运人应当将动物装在适合载运动物的飞机舱内。动物在运输过程中死亡,除承运人的过错外,承运人不承担责任。0601中国民用航空法律法规汇编

The Carrier shall arrange the animals in the aircraft cabin suitable for animal carriage. If the animal dies during the course of transport, the Carrier shall assume no responsibility unless such death is caused by the Carrier.

第三十四条 托运人托运鲜活易腐物品,应当提供最长允许运输时限和运输注意事项,定妥舱位,按约定时间送机场办理托运手续。

Article 34 When consigning fresh and perishable goods, the Shipper shall indicate the allowable longest shipping time and transport instructions, determine the shipping space and complete the consignment procedures at the agreed time and at the airport.

政府规定需要进行检疫的鲜活易腐物品,应当出具有关部门的检疫证明。

For fresh and perishable goods subject to quarantine as required by government regulations, the Shipper shall provide a quarantine certificate issued by a relevant authority.

包装要适合鲜活易腐物品的特性,不致污染、损坏飞机和其它货物。客运班机不得装载有不良气味的鲜活易腐物品。

The packaging of fresh and perishable goods shall be suitable for the characteristics of the goods and designed to prevent contamination or damage to the aircraft and other goods. The passenger transport is prohibited to carry any fresh and perishable goods with objectionable odor.

需要特殊照料的鲜活易腐物品,应由托运人自备必要的设施,必要时由托运人派人押运。

For fresh and perishable goods requiring special care, the Shipper shall provide necessary facilities and assign the cargo attendant if necessary.

鲜活易腐物品在运输、仓储过程中,承运人因采取防护措施所发生的费用,由托运人或收货人支付。

The Shipper or Consignee shall pay for any expenses arising from necessary protective measures taken by the Carrier during the transport and storage of fresh and perishable goods.

第三十五条 贵重物品包括:黄金、白金、铱、铑、钯等稀贵金属及其制品;各类宝石、玉器、钻石、珍珠及其制品;珍贵文物(包括书、画、古玩等);现钞、有价证券以及毛重每公斤价值在人民币2000元以上的物品等。

Article 35 Valuables include precious metals like gold, platinum, iridium, rhodium and palladium and the products made of them; various jewelry, jade ware, diamonds, pearls and their products, precious historic relics (including ancient calligraphy, paintings and antiques), cash, securities, and items worth over RMB 2,000 per kilogram of gross weight.

贵重物品应当用坚固、严密的包装箱包装,外加#字型铁箍,接缝处必须有封志。

Valuables shall be packed in a firm, tight packing box wrapped with “#” shaped iron hoop and there shall be a sealing mark at the connecting portions.

第三十六条 枪支、警械(简称枪械)是特种管制物品;弹药是特种管制的危险物品。托运时应当出具下列证明:

Article 36 Firearms and police equipment (referred to as firearms) are listed in the Special Controlled Goods Category. The ammunition is the dangerous goods subject to special control. The following document shall be provided for consignment:

(一)托运人托运各类枪械、弹药必须出具出发地或运往县、市公安局核发的准运证或国家主管部委出具的许可证明;

(1) When consigning various firearms and ammunition, the Shipper must present the transport permit issued by the security bureau at the municipal or county level at the place of departure or destination or an approval document issued by a competent national authority.

(二)进出境各类枪支、弹药的国内运输必须出具边防检查站核发的携运证;枪械、弹药包装应当是出厂原包装,非出厂的原包装应当保证坚固、严密、有封志。枪械和弹药要分开包装。

(2) When importing and exporting various firearms and ammunition, the phoresy certificate issued by the frontier inspection station must be provided. The packing of the firearms and ammunition shall be original. The non-factory packing shall be secure and tight with seal marks. The firearms and the ammunition shall be packed separately.

枪械、弹药运输的全过程要严格交接手续。 The whole course of firearms and ammunition transport must be strictly in accordance with the handing over procedures.

第三十七条 根据货物的性质,在运输过程中需要专人照料、监护的货物,托运人应当派人押运,否则,承运人有权不予承运。押运货物需预先订妥舱位。

Article 37 According to the properties of cargo, for cargo required of care and guard by specially-assigned person during the course of transport, the Shipper shall provide the cargo attendant, or, the Carrier is entitled to reject the consignment. The shipping space shall be arranged in advance for consignment.

押运员应当履行承运人对押运货物的要求并对货物的安全运输负责。押运员应当购买客票和办理乘机手续。

The cargo attendant shall fulfill the requirements of the Carrier regarding the cargo transport and be responsible for the safe transport of cargo. The cargo attendant shall buy a passenger ticket and check-in.

托运人派人押运的货物损失,除证明是承运人的过失造成的以外,承运人不承担责任。经证明是由于承运人的过失造成的,按本规则第四十五条的有关条款赔偿。

If the cargo with cargo attendant provide by the Shipper is subject to loss, the Carrier assumes no responsibility unless it is proved that such loss is caused by the mistake of the Carrier. If it is proved that such loss is resulted from the mistake of the Shipper, he/she shall compensate in accordance with the related terms under Article 45 of this Regulations.

承运人应当协助押运员完成押运任务,并在押运货物包装上加贴押运标贴。在货运单储运注意事项栏内注明押运字样并写明押运的日期和航班号。

The Shipper shall assist the cargo attendant with transport and mark the corresponding cargo package with label as "Escort". In the "Notes for Storage" of the AWB, the word "Escort" shall be indicated as well as the date and flight for transport.

第五章 航空邮件及航空快递运输

Chapter V Airmail and Air Express Transportation

第三十八条 航空邮件的托运和承运双方要相互协作、密切配合,按公布的航班计划和邮件路单安全、迅速、准确地组织运输。

Article 38 The Shipper and the Carrier of the airmail shall cooperate and coordinate with each other tightly to organize safely, quickly and accurately for transport according to the released flight scheduling and mail waybill.

航空邮件应当按种类用完好的航空邮袋分袋封装,加挂航空标牌。

The airmail shall be sealed and packed separately with airmail bag in good condition according to the mail type. The label of "Aviation" is provided.

承运人对接收的航空邮政信函应当优先组织运输。

The Carrier shall prior transport the airmail received.

航空邮件内不得夹带危险品及国家限制运输的物品。

The airmail shall contain no dangerous goods or goods restricted from transport by the nation.

航空邮件应当进行安全检查。

The airmail shall be subject to safety inspection.

航空邮件按运输时限的不同计收相应的运费。

The freight charges of the airmail is based on the specific transport time limit.

承运人运输邮件,仅对邮政企业承担责任。

The Carrier transports the mails and is only responsible for the postal enterprise

第三十九条 航空快递企业要以本规则为依据,使用专用标志、包装。

Article 39 The air express enterprise shall be based on this Regulations and use the special marks and packaging.

航空快递企业应当安全、快速、准确、优质的为货主提供服务,并按规定收取相应的服务费。发生违约行为时应当承担相应的经济责任。

The air express enterprise shall safely, quickly and accurately provide the owner of cargo with high-quality services and charge for specified service fees. The air express enterprise shall assume the corresponding economic responsibility with respect to non-performance.

第六章 货物包机、包舱运输

Chapter VI Airplane and Cabin Chattered Transportation

第四十条 申请包机,凭单位介绍信或个人有效身份证件与承运人联系协商包机运输条件,双方同意后签订包机合同。包机人与承运人应当履行包机合同规定的各自承担的责任和义务。

Article 40 Application for airplane chattered. The Shipper contacts with the Carrier for discussing about the conditions for airplane chattered transportation with the introduction letter issued by the employer and valid personal identity document provided. Upon the agreement of both parties, the Shipper and the Carrier sign the Airplane Chattered Contract. The Contractor and the Carrier shall perform their own responsibilities and obligations as specified under the above Contract.

包机人和承运人执行包机合同时,每架次货物包机应当填制托运书和货运单,作为包机的运输凭证。

When the Contractor and the Carrier are executing the Airplane Chattered Contract, a SLI and an AWB shall be completed for each chattered airplane as the certificate of transport.

包机人和承运人可视货物的性质确定押运员、押运员凭包机合同办理机票并按规定办理乘机手续。

The Contractor and the Carrier may determine a cargo attendant according to the properties of cargo, and the cargo attendant shall buy the air ticket check-in as specified based on the Airplane Chattered Contract.

第四十一条 包用飞机的吨位,由包机人充分利用。承运人如需利用包机剩余吨位应当与包机人协商。

 Article 41 The tonnage of airplane chattered is fully used by the Contractor. The Carrier shall consult with the Contractor if the former requests to use the rest tonnage of the airplane chattered.

第四十二条 包机合同签订后,除天气或其它不可抗力的原因外,托运人和承运人均应当承担包机合同规定的经济责任。

Article 42 Upon signing the Airplane Chattered Contract, unless for weather and other force majeure reasons, the Shipper and the Carrier shall assume the economic responsibilities as specified in the Airplane Chattered Contract.

包机人提出变更包机前,承运人因执行包机任务已发生调机的有关费用应当由包机人承担。

Before the Contractor requests any change to the airplane chattered, the Contractor shall be responsible for all related expenses generated by the Carrier for changing the airplane chattered in order to fulfill the airplane chattered mission

第四十三条 包用飞机,承运人按包机双方协议收取费用。

Article 43 Airplane chattered. The Carrier shall charge based on the agreement between both parties.

第四十四条 申请包舱或包集装板(箱)的合同签定及双方应当承担的职责和义务参照包机的有关条款办理。

Article 44 Refer to the terms with respect to airplane chattered for signing the contract for shipping space or container chattered and the responsibilities and obligations of each party.

第七章 货物不正常运输的赔偿处理

Chapter VII Indemnification to Improper Transportation

第四十五条 由于承运人的原因造成货物丢失、短缺、变质、污染、损坏,应按照下列规定赔偿;

Article 45 In case of loss, shortage, deterioration, contamination, or damage to the cargo caused by the Carrier, it shall make compensation in accordance with the following provisions:

(一)货物没有办理声明价值的,承运人按照实际损失的价值进行赔偿,但赔偿最高限额为毛重每公斤人民币20元。

(1) As to cargo without declared value, the Carrier shall compensate based on the value of practical loss with the upper limit of RMB 20 per kilogram in gross weight.

(二)已向承运人办理货物声明价值的货物,按声明的价值赔偿;如承运人证明托运人的声明价值高于1601民用航空规章货物的实际价值时,按实际损失赔偿。

(2) As to cargo with value declared to the Carrier. the Carrier shall compensate based on the declared value. If the Carrier proves that the value declared by the Shipper is higher than the actual cargo value as specified in 1601 Civil Aviation Regulations, the Carrier shall compensate based on the practical loss.

第四十六条 超过货物运输合同约定期限运达的货物,承运人应当按照运输合同的约定进行赔偿。

Article 46 The Carrier shall compensate according to the Transport Contract in case the cargo is delivered beyond the time limit agreed in the Cargo Transport Contract.

第四十七条 托运人或收货人发现货物有丢失、短缺、变质、污染、损坏或延误到达情况,收货人应当场向承运人提出,承运人应当按规定填写运输事故记录并由双方签字或盖章。如有索赔要求,收货人或托运人应当于签发事故记录的次日起,按法定时限向承运人或其代理人提出索赔要求。向承运人提出赔偿要求时应当填写货物索赔单,并随附货运单、运输事故记录和能证明货物内容、价格的凭证或其它有效证明。

Article 47 In case of loss, shortage, deterioration, contamination, or damage to the cargo or delayed delivery is found by the Shipper or Consignee, the Consignee shall notify the Carrier at site and the latter shall complete the transport accident records according to the rules which shall be signed or stamped by both parties. If any claim for compensation arises, the Consignee or the Shipper shall, since the next day upon signing and issuing the accident records and within the legal time limit, require the Carrier or his/her duly authorized Agent to compensate. The Shipper or the Consignee shall complete the cargo indemnification list for achieving the above mentioned compensation requirements with the AWB, transport accident records, documents indicating the content and price of the cargo and other valid proof documents provided.

超过法定索赔期限收货人或托运人未提出赔偿要求,则视为自动放弃索赔权利。

The Shipper or the Consignee is deemed as waiver of claim if both of them fail to raise a claim within the corresponding legal time limit.

第四十八条 索赔要求一般在到达站处理。承运人对托运人或收货人提出的赔偿要求,应当在两个月内处理答复。

Article 48 The claim is generally handled at the airport of destination. The Carrier shall manage and respond, within 2 months, regarding the claim proposed by the Shipper or the Consignee.

不属于受理索赔的承运人接到索赔要求时,应当及时将索赔要求转交有关的承运人,并通知索赔人。

If the Carrier irrelevant to the acceptance of claim receives a claim, he/she shall timely hand over the claim to related Carrier and notify the Claimant.

第八章

Chapter VIII Supplementary Provisions

第四十九条 本规则自199631日起施行。中国民用航空局1985年制定发布的《中国民用航空局货物国内运输规则》同时废止。

Article 49 This Regulations has been put into force upon 1 March 1996. The Domestic Transportation Rule of China Civil Aviation Cargo formulated and issued by CAAC in 1985 was simultaneously abolished.
